Uluslararası Ceza Mahkemesi Koalisyonu, Nepal Devletini  Uluslararası Ceza Mahkemesi (UCM)  kurucu sözleşmesi olan Roma Statüsü’nü tanıyarak uluslararası adalete ve hukukun üstünlüğüne ilişkin bağıtını yerine getirmeye davet eder.

25 Temmuz 2006 tarihinde Temsilciler Meclisinin Nepal hükümetini Roma Statüsünü onaylamaya davet eden kararı, çatışma sonrası dönemdeki önemli gelişmelerin işaretini oluşturmuştur.

Roma Statüsüne taraf olarak Nepal hukukun üstünlüğünü yerleşik hale getirecek ve uluslar arası insan hakları standartlarını hayata geçirme bağlılığını güçlendirecektir.

Şimdiye değin Asya kıtasından yalnızca 7 devlet Roma Statüsüne taraf olmuştur. Nepal’in Roma Statüsüne taraf olması bir yandan Nepal’deki insan hakları mevzuatını güçlendirecek, öte yandan da Asya’nın deneyimini Mahkemeye bir adım daha yaklaştıracaktır.

Your Excellency,

I am writing to urge you to ensure Nepal’s accession to the Rome Statute of the ICC as soon as possible. The Court’s investigations in Uganda, Central African Republic, the Democratic Republic of Congo, Kenya and Sudan signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. Nepal’s support for this new and vital system of international justice by acceding to the Rome Statute is therefore of the utmost importance.

The Rome Statute came into force in July 2002 and now has the support of well over half of the world’s nations. As of April 2010, 111 states have ratified or acceded to the treaty, and 139 are signatories. The 111th state party is Bangladesh, the first South Asian country to embrace the treaty. While Bangladesh’s ratification is certainly instrumental in ensuring a larger representation of the Asia region at the ICC, Asian states are still underrepresented in the Treaty. Nepal’s accession to the Rome Statute would contribute immensely to your country’s objective to help end impunity and strengthen the rule of law.

Global support for the Rome Statute is crucial to building, strengthening, and ensuring the success of the first permanent, independent court capable of investigating and bringing to justice individuals who commit war crimes, crimes against humanity, genocide, and, once defined, the crime of aggression. Therefore, I urge your Excellency to use your good offices to ensure prompt treatment of the accession dossier as soon as possible, and by doing so express its ongoing support for justice and human rights.
